1. NAME OF THE SITE AND OWNERSHIP
These general conditions of sale or, alternatively, "GCS" govern the offer and sale of Products distributed through the websites caf-florenceleather.com and caf-florenceleather.it by
CAF di Capanni Fabio e C. sas (henceforth referred to simply as CAF),

Scope of application of the GCS
1.1 The offer and sale of products on the site constitute a distance contract governed by Chapter I, Title III (articles 45 et seq.) Of Legislative Decree 6 September 2005, n. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, n. 70, containing the regulation of electronic commerce.
1.2 These general conditions of sale apply to all contracts concluded with CAF on the site.
1.3 The general conditions of sale can be modified at any time. Any changes and / or new conditions will be in force, users are therefore invited to access the site regularly and to consult the most updated version of the general conditions of sale before making any purchase.
1.4 The applicable general conditions of sale are those in force on the date of sending the purchase order.
1.5 These general conditions of sale do not regulate the sale of products by parties other than CAF that are present on the site through links, banners or other hypertext links. Before carrying out commercial transactions with these subjects it is necessary to check their conditions of sale.
1.6 The user is obliged to carefully read these general conditions of sale, which CAF makes available to him in the "general conditions of sale" section of the site and of which he is allowed to store and reproduce, as well as all other information that CAF provides it on the site, both before and during the purchase process.
2. PURCHASES ON THE WEBSITE
2.1 The purchase, pursuant to clause 4 below, is allowed both to users who have the quality of consumers, and to users who do not have this quality. Individuals are allowed to purchase only on condition that they are at least eighteen years old.
2.2 Pursuant to art. 3, I comma, lett. a) of the consumer code, we remind you that natural persons who, in relation to the purchase of the products, act for purposes unrelated to any entrepreneurial, commercial, professional or craft activity carried out.
2.3 CAF reserves the right to reject orders submitted by users; orders will certainly be refused that come (i) from a user with whom it has an ongoing legal dispute; (ii) by a user who has previously violated these GCS and/or the conditions and/or terms of the purchase contract with CAF; (iii) by a user who has been involved in fraud of any kind and, in particular, in fraud relating to credit card payments; (iv) by users who have released false, incomplete or in any case inaccurate identification data or who have not promptly sent CAF the documents requested by the same or that they have sent invalid documents.
3. REGISTRATION TO THE SITE
3.1 Registration to the site is free. To register on the site, the user must fill in the appropriate form, entering name, surname, address, place and date of birth, telephone number, an e-mail address and a password and click on the "submit" button. Registration on the site, by opening a personal account, allows the registered user "registered user" to: - save and modify their data - access all information relating to orders and returns - follow the status of the order - manage their personal data and update them at any time - take advantage of the dedicated services that may be activated from time to time (eg: display of your "wish list", etc) - express consent to the processing of their personal data by CAF for sending newsletter
3.2 The registration credentials (e-mail address and password) must be kept with extreme care and attention. They can only be used by the user and cannot be transferred to third parties. The user undertakes to keep them secret and to ensure that no third parties have access to them. He also undertakes to immediately inform CAF, by contacting her via email at email@example.com or by telephone at no. +39.055 846 619, in the event that it suspects or becomes aware of an improper use or undue disclosure of the same.
3.3 The registered user guarantees that the personal information provided during the registration procedure on the site is complete and truthful and undertakes to keep CAF harmless and indemnified from any damage, compensation obligation and/or sanction deriving from and/or in any way connected to the violation by the user of the rules of registration on the site or on the conservation of registration credentials.
4. CANCEL OR MODIFY AN ORDER
To modify or cancel an order it is necessary to contact no later than 24 hours after sending the order CAF, via email at firstname.lastname@example.org or by phone at +39.055 846 619 always indicating the reference order number.
5. INFORMATION ON THE STATUS OF THE ORDER AND SHIPMENTS
At the time of shipment, the User will receive the shipping number at the email address indicated in the order phase through which he can track his purchases on the courier's website or through the call center of the same.
6. INFORMATION ON INVOICES, BANK TRANSFERS, REQUEST COPIES OF DOCUMENTS AND DETAILS CHANGES
To request copies of tax documents and/or personal data changes, the User must contact CAF via mail at email@example.com or by telephone at +39.055 846 619 remembering to always indicate the type and number of the document for which the copy and/or correction is requested.
7. PAYMENT METHODS
Purchased made on caf-florenceleather.it and caf-florenceleather.com are safe and guaranteed, payment can be made by choosing one of the following methods:
- payment by advance bank transfer
- payment by credit card
- payment with paypal system
Payment by advance bank transfer
7.1 In case of payment by bank transfer in advance the order will be handled only after confirmation of the full amount credited. Payment must be made within 5 working days from the date of the order. For a correct and fast management of the order, the customer must indicate the order number, date, name and surname of the customer in the reason for payment. After this deadline the order will be automatically canceled.The availability of the chosen product will be assessed at the time of accreditation. The transfer must be made out to: CAF di Capanni Fabio e C. sas, Via della Giustizia, 7 50038 Scarperia Firenze (IT) IBAN : IT09J0103037750000063427247, CAB: 37750, BIC SWIFT code: PASCITMMBSL.
Payment by credit card
7.2 Where the User chooses to pay by credit card the reference bank will authorize the debit of the amount relating to the purchase made. In case of cancellation it will be requested by CAF the cancellation of the transaction and the reversal of the committed amount. The release times depend exclusively on the banking system. Once the transaction has been canceled, CAF will in no case be held responsible for delays and/or damages caused by the banking system. CAF reserves the right to request additional information from the User or to send copies of documents proving ownership of the card used. In case of refusal CAF reserves the right not to accept the conclusion of the contract. At no time during the purchase procedure by credit card is CAF able to know personal information relating to the owner as the information is transmitted directly to the site of the bank that manages the transaction, a protected site.
Payment with PayPal
7.3 Selecting the paypal payment type, the User will be redirected to a page of the PayPal site and payment will be made according to the methods indicated therein. The information provided on the paypal site will not be shared with CAF but they will be managed directly by the same. In case of cancellation of the order or non-acceptance by CAF the amount will be refunded to the PayPal account. CAF will not be in any way responsible for delays and/or damages caused in this phase.
8. SHIPPING AND COSTS
The cost of shipping is charged to the user and will be calculated automatically by the system. Any customs fees are not included in the item price or shipping charges. These costs are the responsibility of the buyer and must be paid to the courier.
9. DELIVERY TIMES AND METHODS
Orders will be managed by CAF from Monday to Friday from 9:00 to 12:00. Orders placed after 12:00 and during the weekend will be handled from the next business day. In the case of a first order CAF reserves the right to ask its bank to contact the customer's bank for approval of the payment. Average shipping time: Italy 3-5 working days, Europe 4-8 working days, Extra Eu 5-10 working days. Considering that our products are entirely handmade, the total production and delivery time can vary from 2 to 10 days. In any case the delivery date is purely indicative and it is in no way binding for CAF.
9.1 With the confirmation of the purchase by the customer, a business relationship is concluded which commits the customer to collect the goods upon delivery. If for any reason the customer does not collect the goods, the shipping and storage costs will be charged to the customer and deducted from any reimbursement of CAF.
9.2 The courier in charge will request, upon delivery of the package, the signature of the recipient or whoever takes his place as proof of delivery. It is possible to make requests for changes to any information necessary for the delivery of the order either through the customer service of CAF, or directly to the courier in charge. If the recipient, or whoever takes his place, agrees directly with the courier in charge for a delivery of the goods without affixing his signature, CAF will not be held responsible for any shortcomings and no claim can be made against the company.
10. ORDER STATUS
We remind customers that they can check the status of their order by sending an email to the email address firstname.lastname@example.org, or by calling customer service indicating the name and order number or by entering your account if you are a Registered user.It is not possible to cancel or modify an order that is already in the shipped status.
11. RIGHT OF WITHDRAWAL
11.1 The right of withdrawal is governed by the current legislation art. 64 of the consumer code as amended by the Legislative decree 21 February 2014, n. 21. The user who holds the status of consumer referred to in point 3.2 has the right to withdraw from the contract for any reason and without any penalty within 14 working days from the receipt of the order and without having to incur costs other than those provided for in article 56, paragraph 2, and article 57 of the aforementioned decree. 11.2 Right of withdrawal and refund of personalized and / or made-to-measure garments
Pursuant to art. 59, second paragraph, of the Consumer Code, the Customer has no right of withdrawal in the case of supply of tailor-made or customized products. CAF provides for the refund of the sum spent, after returning the purchased products within 30 days of receipt of the goods, ONLY if the packaged product has structural imperfections or problems of use. In this case, the Customer is required to proceed as follows:
Send by e-mail to email@example.com or by registered letter to the address below, attaching 4 photos of the product (seen from the front, side, back, inside) so that the defect is visible.
The complaint is viewed and approved by the CAF staff, who will communicate their approval to the customer.
The garment to be returned must be boxed in the original packaging and sent at your own expense, together with the return approval form, with traceable shipping method to the address: CAF di Capanni Fabio e C. sas - Via della Giustizia, 7 50038 Scarperia Firenze (IT ). Within 14 working days of receipt of the product, the amount will be re-credited with the same payment method used at the time of purchase if possible (Credit Card on the website, PayPal). Otherwise, the customer must communicate the bank details on which he wishes to receive the refund in the email. Any product sent without following the above procedure will not be accepted and will be returned to the sender, without issuing any refund. Once the above conditions are met, the buyer has the right to be reimbursed for the full amount. The Customer loses the right to reimbursement if CAF ascertains the existence of even one of the following conditions:
Use, even partial, of the goods and any consumables;
Lack of external packaging and / or of the original internal packaging;
Absence of product components (accessories);
Damage to the product.
In the cases indicated above, CAF will return the goods to the Customer, charging the shipping costs.
Note: Those who purchase with VAT number cannot exercise the right of withdrawal.
12. RETURNS AND REFUNDS
It is possible to request a return for all items on sale, with the exception of customized models and those who purchase with VAT Number, to obtain an exchange or a refund. The return shipping costs will be chargeable to the user. In the event of an exchange, the costs will be paid by CAF. The request for return or exchange can be made by sending an email to firstname.lastname@example.org. After entering the order number and the email used for the purchase, enter the reason for the return, or confirm an exchange. Once the return is approved by CAF, you will receive an email with all the relative information. CAF, reserves the right to refuse the return or to request additional information, photos or other elements on the product to be returned. The goods must be returned within 14 days from the date of receipt. Refunds will be processed once the return sent by you has been received and accepted. In case of approval, the costs of customs, duties, and other taxes related to the return shipment will be deducted from the refund. In the event of an exchange, these costs will be chargeable to CAF. If you're ordering outside of Europe, your order may be subject to customs and import duties. CAF has no control over these charges and their amount, as customs policies and import duties vary from country to country. For orders paid by credit card or PayPal, the payment will be reversed with consequent re-credit to the current account by your bank. The times for any refunds may vary also from your bank, therefore they are not only dependent on the activity of CAF (generally the re-credit is done within 10 working days by the return's approval).
13. FORFEITURE OF THE RIGHT OF WITHDRAWAL
The user loses the right of withdrawal and the consequent right to reimbursement in the event that CAF ascertains the verification of even one of the following conditions:
- use, even partial, of the goods and any materials of consumption
- lack of external packaging and/or original internal packaging
- absence of product components (accessories) - damage to the product for reasons other than its transport
In the cases indicated above CAF will return the goods to the User by charging the shipping costs.
14. JURISDICTION AND APPLICABLE LAW
The purchase contract concluded on the Site is subject to Italian jurisdiction and is governed by Italian law.
15.1 SWe remind you that in the case of consumer users, the court of the place where the user resides or has elected domicile is competent for any dispute relating to the application, execution and interpretation of these general conditions of sale. In the case of a non-consumer user, the court of Firenze is exclusively competent for any dispute relating to the application, execution and interpretation of these general conditions of sale.
15.2 The user who resides in a member state of the european union other than Italy, can also access, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale, to the european procedure established for disputes of modest entity, by Regulation (CE) no. 861/2007 of the council, of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, rights and expenses, Euro 2,000.00. 15.3 IIn compliance with the provisions of art. 14 of the EU Regulation 524/2013/EU, the consumer user is informed that, as an alternative to the judicial dispute, both the consumer and CAF can make use of the alternative solution of online disputes by submitting a complaint through the platform set up by the european commission.This tool can be used by the european consumer to resolve in a non-judicial way any dispute relating to and/or deriving from contracts for the sale of goods and services entered into online.
